14A. Fair Usage Policy

The TAU FOODS LTD Membership Programme is designed to provide genuine value to individual Members and legitimate business customers purchasing products for their own reasonable use.

To ensure that Membership benefits remain fair and sustainable for all Members, TAU FOODS LTD operates a Fair Usage Policy.

Membership benefits must not be used in a manner that is excessive, abusive, fraudulent or inconsistent with the intended purpose of the Membership Programme.

Examples of activity that may be considered unfair use include, but are not limited to:

  • sharing Membership discounts with individuals who are not registered Members;
  • placing orders on behalf of multiple unrelated households or businesses;
  • repeatedly changing delivery addresses to allow different people to benefit from a single Membership;
  • using a Membership primarily for resale or other commercial activity that falls outside the intended scope of the Membership Programme;
  • creating multiple customer accounts to obtain additional Membership discounts or promotional offers;
  • circumventing purchase limits, promotional restrictions or other safeguards;
  • providing inaccurate or misleading account, payment or delivery information;
  • allowing another person to access or use your Membership account;
  • engaging in behaviour that, in our reasonable opinion, undermines the fairness or integrity of the Membership Programme.

TAU FOODS LTD may use reasonable measures to identify potential misuse, including reviewing account activity, delivery patterns, order history and other information reasonably necessary to protect the Membership Programme.

Where we reasonably believe that a Membership has been used in breach of this Fair Usage Policy, we may take one or more of the following actions:

  • contact the Member to request further information;
  • temporarily suspend Membership benefits while an investigation is carried out;
  • refuse to apply Membership pricing to affected orders;
  • cancel or refuse orders where permitted by law;
  • require additional identity or address verification;
  • permanently terminate Membership in cases of serious or repeated abuse.

Any action taken by TAU FOODS LTD will be reasonable, proportionate and consistent with applicable law.

Nothing in this Fair Usage Policy limits any statutory rights available to consumers under the laws of England and Wales.

Members who believe their Membership has been restricted in error may contact TAU FOODS LTD using the contact details published on our website. We will review the matter fairly and respond within a reasonable time.

14B. Household and Business Use Policy

The TAU FOODS LTD Membership Programme is intended to benefit the registered Member and, where applicable, members of the same household living at the registered residential address, or the registered business operating from its declared business address.

Membership benefits are not intended to be shared between multiple unrelated households, unrelated businesses or groups of individuals.

For the purposes of these Membership Terms:

  • a Household means individuals who normally reside at the same residential address; and
  • a Business Member means the legal business entity registered as the Membership holder.

Members must ensure that all information provided when purchasing Membership remains accurate and up to date.

14C. Registered Delivery Address

At the time of purchasing Membership, the Member must provide a primary delivery address.

Membership discounts and benefits are normally available only for orders delivered to, or collected in connection with, the registered Membership account.

To protect the integrity of the Membership Programme, TAU FOODS LTD may monitor repeated changes to delivery addresses or delivery locations where reasonably necessary to prevent misuse.

Members may request to change their registered delivery address at any time.

For security and fraud prevention purposes, TAU FOODS LTD may:

  • verify the new address;
  • request proof of residence or business occupancy where reasonably necessary;
  • apply a short verification period before the new address becomes eligible for Membership benefits.

These measures are intended solely to protect Members and maintain the fairness of the Membership Programme.

14D. Orders for Third Parties

Membership benefits are intended for purchases made by the registered Member for their own reasonable household or business requirements.

Orders placed primarily for the benefit of unrelated third parties, or for the purpose of allowing others to receive Membership discounts, may be considered misuse of the Membership Programme.

This does not prevent Members from purchasing gifts or placing occasional orders for family members, friends or colleagues, provided such activity is reasonable, infrequent and not intended to circumvent these Membership Terms.

14E. Reasonable Use

The Membership Programme is designed to support normal household shopping and legitimate business purchasing.

TAU FOODS LTD does not impose fixed purchasing limits. However, unusually high order volumes, repeated bulk purchases or purchasing patterns that are inconsistent with ordinary household or declared business use may be reviewed where reasonably necessary.

A review does not automatically mean that the Member has breached these Membership Terms. TAU FOODS LTD will consider the circumstances of each case individually before taking any action.

14F. Verification

Where reasonably necessary to protect the Membership Programme, TAU FOODS LTD may request additional information to verify:

  • the Member’s identity;
  • the registered residential address;
  • the registered business address;
  • the legitimacy of Membership use.

Examples of acceptable evidence may include:

  • a recent utility bill;
  • a council tax bill;
  • a business registration document;
  • other reasonable evidence confirming the registered address.

Personal information provided for verification will be processed in accordance with our Privacy Policy and applicable data protection laws.

14G. Fair and Proportionate Enforcement

TAU FOODS LTD aims to administer the Membership Programme fairly, consistently and proportionately.

Before permanently suspending or terminating a Membership, we will normally consider:

  • the nature of the suspected misuse;
  • whether the issue appears to be accidental or deliberate;
  • any explanation provided by the Member;
  • whether the Member has previously breached these Membership Terms.

Where appropriate, we may issue a warning or request corrective action before taking stronger measures.

Nothing in this section prevents TAU FOODS LTD from taking immediate action where there is evidence of fraud, criminal activity, serious abuse of the Membership Programme or where immediate action is required by law.

14H. Member Pricing Policy

Membership provides eligible Members with access to exclusive pricing and other benefits offered by TAU FOODS LTD from time to time.

Membership does not guarantee that every product will be available at a discounted price.

Member prices are available only to customers with an active Membership at the time an order is placed and accepted.

14I. Standard Prices and Member Prices

Products displayed on our website may show:

  • a Standard Price available to all customers;
  • a Member Price available only to active Members.

Where both prices are displayed, the Member Price represents the price available only after the customer has logged into their Membership account.

Prices shown on the website are subject to change without notice until an order has been accepted by TAU FOODS LTD.

14J. Eligibility for Member Pricing

Member pricing applies only where all of the following conditions are satisfied:

  • the customer has an active Membership;
  • the customer is logged into the correct Membership account;
  • the Membership has not been suspended or terminated;
  • the order complies with these Membership Terms and the Terms of Service.

If any of these conditions are not met, the Standard Price will apply.

14K. Membership Expiry

If a Membership expires before an order is placed, Member pricing will no longer be available.

Orders accepted while Membership was active will continue to receive the Member pricing confirmed at the time of order acceptance, even if the Membership expires before delivery.

14L. Promotions and Member Discounts

Unless expressly stated otherwise:

  • Member prices may be combined only with promotions specifically identified as compatible;
  • some promotional offers may exclude additional Member discounts;
  • Member-exclusive promotions may be subject to purchase limits, availability or time restrictions.

Where more than one discount could apply, TAU FOODS LTD will normally apply the promotion that provides the greatest benefit to the customer, unless the promotional terms state otherwise.

14M. Pricing Errors

Despite our best efforts, pricing errors may occasionally occur.

Where an obvious pricing error has occurred, TAU FOODS LTD reserves the right to:

  • refuse the order before acceptance;
  • cancel the affected order where permitted by law;
  • contact the customer with the correct price;
  • offer the customer the opportunity to proceed at the correct price or cancel the order.

Nothing in this section affects any statutory rights available to consumers.

14N. Changes to Member Prices

TAU FOODS LTD may introduce, amend or withdraw Member prices, discounts or promotional benefits at any time for operational, commercial or legal reasons.

Such changes will not affect orders that have already been accepted.

14O. Fair Pricing

Member prices are intended solely as a benefit of Membership.

Members may not:

  • reproduce Member prices for commercial advertising;
  • use Member pricing to mislead others;
  • attempt to exploit pricing systems or technical errors;
  • manipulate discounts through automated or fraudulent means.

TAU FOODS LTD reserves the right to investigate suspected abuse and take appropriate action under these Membership Terms.

14P. Non-Transferable Benefits

Membership discounts and pricing benefits are personal to the registered Member.

Member pricing may not be:

  • transferred to another person;
  • exchanged for cash;
  • converted into account credit unless required by law;
  • redeemed outside the registered Membership account.

Benefits cannot be accumulated or traded between different customer accounts.

14Q. Commercial Resale

Unless expressly agreed in writing by TAU FOODS LTD, Membership pricing is not intended to support commercial resale activities beyond the ordinary purchasing needs of the registered Member or approved Business Member.

Where TAU FOODS LTD reasonably believes that products purchased using Member pricing are being acquired primarily for unauthorised resale or to exploit Membership discounts, we may investigate the activity and take appropriate action under these Membership Terms.

Nothing in this section prevents legitimate business customers from purchasing products for use within their own business operations where such use is consistent with the Membership Programme.

14R. Changes to the Membership Programme

TAU FOODS LTD may review and improve the Membership Programme from time to time.

This may include changes to:

  • Member pricing;
  • available benefits;
  • qualifying products;
  • delivery benefits;
  • promotional offers;
  • eligibility requirements.

Where changes materially affect active paid Members, we will normally provide reasonable notice through our website, email or the customer’s online account, unless immediate changes are required for legal, security or fraud prevention reasons.
